Sayyid al-Sistani: It is permissible for a husband who has broken his fast to have intercourse with his fasting wife while she is asleep, but it is forbidden for him to rape her while she is conscious. If he rapes her, he bears no expiation or punishment for her!

[2487] Question 18: If the husband is not fasting due to being a traveler or sick
or the like, and his wife is fasting, it is not permissible for him to force her to have intercourse. If he does so, he bears no expiation or punishment for her. Is it permissible for him to have intercourse with her while she is asleep? There is a difference of opinion (150).
(150) (While she is asleep, there is a difference of opinion: It is not unlikely that it is permissible from this perspective.
