Designated copyright agent

Pursuant to the Digital Millennium Copyright Act (17 U.S.C. §512), ModRaterX Inc (operating CommunityOne) has designated the following agent to receive notifications of claimed copyright infringement. Our agent is registered with the U.S. Copyright Office.

What we host

CommunityOne catalogs user-submitted Discord server listings and mirrors custom emoji images that those servers have chosen to publish on our listing. We act as a service provider hosting material submitted by third parties. We do not claim ownership of third-party emoji artwork or other user-submitted content.

How to send a takedown notice

To file a notice of claimed infringement under 17 U.S.C. §512(c)(3), email our designated agent at [email protected] with all of the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed
  • Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are covered by one notice)
  • Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate it (include the exact URL on communityone.io)
  • Your contact information, including name, mailing address, telephone number, and email address
  • A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed

Incomplete notices may not trigger our obligations under the DMCA safe harbor. Do not send attachments that are not necessary to identify the work or the material.

What happens next

Upon receipt of a substantially compliant notice, we will remove or disable access to the allegedly infringing material expeditiously, notify the submitting server or account holder where reasonably possible, and record the action.

Counter-notice

If you believe material was removed or disabled by mistake or misidentification, you may send a counter-notice under 17 U.S.C. §512(g) to the same designated agent. A valid counter-notice must include:

  • Your physical or electronic signature
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which CommunityOne may be found), and that you will accept service of process from the person who provided the original notification or an agent of such person

If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the original claimant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

Repeat infringer policy

In accordance with 17 U.S.C. §512(i), it is our policy to terminate, in appropriate circumstances, accounts and to delist server listings of users who are repeat infringers. Repeated valid DMCA notices may result in permanent removal of the related content and loss of access to CommunityOne services.

Misrepresentation

Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material or activity is infringing—or that material or activity was removed or disabled by mistake or misidentification—may be liable for damages, including costs and attorneys' fees.
